“Fahreranfrage” driver inquiry letter: When may it be ignored?

Author name: Admin Publication date: 2025-06-25 Article category: traffic law / road traffic law

What is a “Fahreranfrage” letter?
It is an official letter asking you to identify who was driving your vehicle at the time the traffic offence was committed. It is sent to the vehicle owner (Fahrzeughalter) under the German Administrative Offences Act (OWiG – Ordnungswidrigkeitengesetz).

Is it legally acceptable to ignore a Fahreranfrage?
Yes—only in one case:

If the letter is not addressed to you as the actual person concerned/accused, but merely to you as the vehicle owner, you have the right to remain silent and not respond, because you are not legally required to incriminate yourself or a family member.

Reference provision: § 55 OWiG, which guarantees the right to remain silent (Aussageverweigerungsrecht).
You cannot be forced to disclose the driver’s identity if the driver is a first-degree relative (spouse, son/daughter, father/mother).

However, not responding may lead to follow-up measures, such as a Fahrtenbuchauflage (an order to keep a driver logbook for 6–24 months) if the offender cannot be identified.

When is it not permissible to ignore a Fahreranfrage?
If the letter is addressed to you as the actual person concerned (Betroffener) and clearly shows your name as a suspect.
In that case, you must respond or file an objection within 14 days, otherwise the fine may be imposed automatically.

What happens if you ignore the letter completely?
If you are the person concerned:
A Bescheid (penalty notice) may be issued in your absence, and the fine and points are imposed directly.

If you are only the vehicle owner:
The police may start additional investigations (e.g., a home visit), or administrative measures such as a driver logbook may be imposed.

Can a police officer visit you to identify the driver?
Yes. In some cases, the police may visit the owner’s home to compare the driver photo with family members. This step is legal if the driver’s identity is not confirmed.

When is it recommended to respond to a Fahreranfrage?
If the driver is another person with no close family relationship, to avoid bearing the offence instead of them.
If you intend to cooperate to reduce consequences or settle the matter faster.

Final notes
Do not rush to respond to a Fahreranfrage without knowing your legal status in the letter.
It is best to keep a copy of the letter and ensure your reply is drafted in a legally precise manner.
In complex cases, consulting a lawyer specialized in traffic law can be helpful.
