Post-Surgery Visa Extension in Germany – Legal Requirements for Continued Stay
After surgery in Germany, medical follow-up may exceed the original visa duration. Patients can apply for a medical stay extension, provided the necessity is clearly documented.

§ 81 Abs. 4 AufenthG: permits extension for urgent humanitarian/medical reasons if applied before visa expiry.
Eligible Applicants

Patients with medical treatment visa (§14 AufenthV)

Patients on Schengen visa (90 days) seeking conversion to medical stay

Caregivers if continued presence is medically required
Key Requirements

Detailed medical report: current condition, necessity of follow-up, estimated duration

Proof of financial means: bank statement, guarantor, valid insurance

Application before visa expiry at local Ausländerbehörde

Proof of residence (registration or rental contract)
Extension Duration

4–12 weeks for standard follow-up

Up to 6 months for rehabilitation

Application Submission At Ausländerbehörde with: passport, photo, medical documents, insurance, residence and financial proof. If appointment unavailable before expiry: submit via email/fax for deadline protection (Fristwahrung).
