Post-Surgery Visa Extension in Germany – Legal Requirements for Continued Stay

After surgery in Germany, medical follow-up may exceed the original visa duration. Patients can apply for a medical stay extension, provided the necessity is clearly documented.

Legal Basis

  • § 81 Abs. 4 AufenthG: permits extension for urgent humanitarian/medical reasons if applied before visa expiry.

Eligible Applicants

  • Patients with medical treatment visa (§14 AufenthV)

  • Patients on Schengen visa (90 days) seeking conversion to medical stay

  • Caregivers if continued presence is medically required

Key Requirements

  • Detailed medical report: current condition, necessity of follow-up, estimated duration

  • Proof of financial means: bank statement, guarantor, valid insurance

  • Application before visa expiry at local Ausländerbehörde

  • Proof of residence (registration or rental contract)

Extension Duration

  • 4–12 weeks for standard follow-up

  • Up to 6 months for rehabilitation

  • Renewable if medical need persists

Application Submission At Ausländerbehörde with: passport, photo, medical documents, insurance, residence and financial proof. If appointment unavailable before expiry: submit via email/fax for deadline protection (Fristwahrung).

Possible Rejections

  • Application after visa expiry

  • Insufficient medical documentation

  • Suspected misuse for immigration

  • Lack of insurance or funds

Additional Notes

  • Medical report must be signed/stamped by German doctor/hospital

  • Schengen C visas only extendable in emergencies → conversion to §11 or §25 Abs. 5 AufenthG advised
