Social Assistance (Sozialhilfe, § SGB XII): When Are You Entitled to Apply?
Sozialhilfe – regulated under the Twelfth Book of the German Social Code (SGB XII) – is the last safety net in Germany’s welfare system. It is intended for people who are permanently or temporarily unable to secure their own livelihood.
People who cannot work or can only work to a very limited extent (less than 3 hours per day). This includes elderly people, those with permanent or temporary disabilities and persons with serious health problems (bundesregierung.de).
Those who cannot cover their basic living costs from their own income or from other benefits (such as Bürgergeld or housing benefit/Wohngeld), and who cannot receive sufficient support from relatives (betanet.de).
People who are fully reduced in earning capacity or who have reached retirement age and whose living costs are not sufficiently covered by other benefits (bmas.de).
In case of temporary incapacity (e.g. serious illness, long-term treatment) or permanent incapacity to work (disability excluding gainful employment).
If your income and assets are not sufficient to cover the necessities of life and other authorities do not bridge this gap.
Do not wait too long: in some situations, the authority may start providing assistance even without a formal application if it becomes aware of your need.
• Basic subsistence support
This covers essential daily needs such as housing, heating, food, clothing and social participation, according to §§ 27–40 SGB XII (de.wikipedia.org).
• Health insurance / medical care
If you are not insured elsewhere, the social welfare office can cover the costs of medical treatment and healthcare.
• Long-term care
Support may be granted for nursing and long-term care costs, either at home or in a care facility, if these are not covered by other social insurance schemes.
• Special assistance in social difficulties
Additional support is available to cope with:
Social difficulties or isolation,
Acute housing crises,
Long-term unemployment,
Addiction problems, etc.,
based on §§ 67–74 SGB XII (bmas.de).
Before Social Assistance is granted, other options must be exhausted:
Own income and assets (above protected allowances),
Benefits from other schemes (e.g. health insurance, Bürgergeld if you are able to work),
Support from liable relatives.
Only when these options are insufficient or unreasonable, Sozialhilfe steps in as a subsidiary benefit of last resort.
You submit your application to the social welfare office (Sozialamt) in your city or district (bundesregierung.de).
Typically, you must include:
Proof of identity and residence status,
Evidence of income, unemployment or reduced earning capacity,
Statements on assets (bank accounts, savings, property),
Information about health insurance or need for care,
Data on family members living in your household.
If you live in a care home or other facility, documentation of this residence is also required.
Additional income next to benefits for basic needs and housing must be disclosed; if overpayments occur, repayment can be required.
In cases of unlawful receipt of benefits (e.g. hidden assets) or a later inheritance, the authorities may claim reimbursement from you or your heirs.
You have the right to file an objection (Widerspruch) within one month of receiving the decision.
If the objection is rejected, you may bring a case before the Social Court (Sozialgericht) (de.wikipedia.org).
Bürgergeld (SGB II) is for people who are able to work but cannot secure their livelihood from their own resources.
Social Assistance (Sozialhilfe, SGB XII) is for people who are not able to work at all (e.g. permanently reduced earning capacity, older people).
In both systems, you must exhaust all other sources of income and benefits before becoming eligible.
| Situation | Scheme | Notes |
|---|---|---|
| Reduced capacity to work (< 3 hrs/day) | Sozialhilfe | Under SGB XII |
| Able to work but in need | Bürgergeld | Under SGB II |
| No income + limited assets | Sozialhilfe | After all options exhausted |
| Later inheritance / unjustified benefits | Repayment may be required | Possible reimbursement |
Conclusion
If you struggle to pay for your living expenses or healthcare because you are unable to work or have very low income, Social Assistance under SGB XII provides comprehensive, individualized support.
It is advisable to apply early and submit all relevant documents to the Sozialamt in order to protect yourself and secure a dignified standard of living.
