Germany’s Top Court Rejects Lawsuit to Block Arms Sales to Israel

Germany’s Federal Constitutional Court in Karlsruhe has rejected a lawsuit filed by a Palestinian from Gaza seeking to stop the government from authorizing arms exports to Israel.

The case, supported by the European Center for Constitutional and Human Rights, challenged a license issued by the Federal Office for Economic Affairs and Export Control in Hesse, which allowed a German arms company to export tank parts used by the Israeli army in Gaza.

Lower courts had already dismissed the case in 2024 and 2025. The Constitutional Court upheld those rulings, stating the plaintiff failed to provide sufficient evidence that the courts misjudged or arbitrarily denied his protection rights.

The court emphasized that Germany’s commitment to human rights and international humanitarian law does not necessarily oblige the state to take specific measures on behalf of individuals.
